Summary
Dan il-kaz kien jirrirwarda l-preskrizzjoni. Il-Qorti qalet l-ewwelnett illi c-citazzjoni giet ipprezentata fid-19 ta' Novembru 1993, u dan dwar reati allegatament kommessi fl-1991 u fl-1992. Saru emendi fl-2002 permezz ta' l-Att III ta' dik is-sena. Fost dawn l-emendi gie mizjud is-subartikolu (2)ghall-artikolu 687 tal-Kodici Kriminali li jipprovdi: “Iz-zmien ta' preskrizzjoni ghar-rigward ta' kull reat kriminali ghandu jkun sospiz mill-waqt li imputazzjoni u, jew att ta' akkuza jigu notifikati lill-persuna akkuzata jew imputata sa dak iz - zmien meta tinghata sentenza finali u definittiva fil-procedimenti li jkunu inbdew bhala rizultat ta' dik l-imputazzjoni jew att ta' akkuza.” Qabel tali zieda kien applikabbli biss l-artikolu 693 tal-Kodici Kriminali li fis-subartikolu (1) jipprovdi:“Iz-zmien tal-preskrizzjoni jinkiser b'kull att tal-procediment li jigi innotifikat lill-imputat jewakkuzat dwar il-fatt li ghalih ikun imputat jew akkuzat.”
Il-Professur Sir Anthony Mamo fin-Noti tieghu dwar Procedura Kriminali1 jghid dwar sitwazzjoni bhal dik odjerna fejn l-azzjoni bdiet tahtligi wahda u tterminat meta ligi gdida giet fis-sehh:
“The most commonly accepted doctrine is that where the laws which succeed one another vary as to the conditions or effect of prescription, the same principle should apply, as govern the operation of substantive criminal law in the same circumstances, i.e.:
“(1) that the law in force at the time of the commission of the offence appliesto the prescription which has commenced to run while the law was in force;
“(2) that nevertheless, the provisions of a subsequent law which comes into operation after the commencement of prescription apply retrospectively if they are more favourable to the defendant.”
