PRESKRIZZJONI TA REAT

F'dan il-kaz tqajmet il-kwistjoni tal-bidu tal-preskrizzjoni li kien jiddependi jekk ir-reat kienx istaneju jew permanenti. Illi l-Professur Anthony Mamo fin-noti tieghu fuq id-dritt penali fil-pagna12 et sequitur jaghmel distinzjoni bejn dawn iz-zewg tipi ta' reat. Hu jiddenfinixxi r-reat istantaneju f'din il-manjiera:
"An offence is instantaneous if the violation of the right or interest protected by the law is entirely completed as soon as all the elements constituting the offence actually concur."
Min-naha l-ohra r-reat permanenti hu deskritt:
"A continuing offence is one which consists in a state of things subjectively and objectively and uniformly contrary to law in everymoment of its duration. Here the
injury or the violation of the right or interest protected by the law continues and is repeated uninterruptedly even after the completion of the act or omission giving rise to the offence."
Illi dan il-kaz kien jirigwarda trasferiment ta' kollezzjoni ta' ghasafar minghajr il-permessi mehtiega.
Illi fil-fehma tal-Qorti ir-reat in ezami kien wiehed istantaneju u allura il-preskrizzjoni bdiet mid-data tat-trasferiment.
